This Privacy Policy explains our practices, defines our users’ (“you” or “your”) privacy options, and describes how your information is collected and used by Z-USA (“we,” “us,” or “our,” or “Z-USA”).

This Privacy Policy, along with our Website Terms of Use governs your use of the Z-USAwebsite at https://airscooter.shop, including products, services and experiences relating to the AirScooter experience at our flight center(s) (the “Site”), our Air Scooter Terms and Conditionsgoverns your purchase of and participation in the AirScooter flight experience, and any information we may access through our social media platforms such as Facebook, Instagram or Youtube. For the purposes of this Privacy Policy, we will refer to all of these access points as Z-USA system (the “System”).

Personal Information means any identifying information, usually your name in combination with another identifier, such as date of birth, postal address, email address, telephone number, or government-issued identification number. Personal Information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of Personal Information varies from one jurisdiction to another.

We may update this Privacy Policy from time to time and will mark new versions with a corresponding effective date. We recommend you visit the Site to review any changes in our practices. Your continued use of the System constitutes your agreement to our then-current Privacy Policy.

What Information is Collected?

 

Information Collected Directly from You

We may collect Personal Information about you when you subscribe to our newsletter, visit our Site, complete a booking for our AirScooter flight experience, or as part of other online services.

 

The information we may collect includes:

• Identifiers or contact information, such as a real name, physical address, IP address, phone number, and email address
• Personal information categories such as a name, date of birth, or telephone number
• Commercial information, such as records of products or AirScooter experiences purchased, obtained, or considered, or other purchasing or consuming histories or tendencies
• Internet or other similar network activity, such as browsing history or information on a user’s interaction with our Site 

We may also collect information from you when you register for our AirScooter flight experience online using account credentials from third-party services such as Google or Facebook (“Single Sign” or “SSO”). If you choose to use SSO, we will receive certain information such as your name, email address, and any other information that you authorize us the provider of the SSO to share with us. We use this information to provide the Site and services to you and communicate with you. We do not control their privacy practices, so please refer to the terms of use and privacy policy of the SSO. You may disconnect your SSO account from our System by contacting us.

 

Information Collected Automatically

To provide you with services, complete your requests and maintain a functional System, we may automatically collect certain information when you visit or navigate the Site, including:

• Location, date and time you access the System, and IP addresses to measure our website traffic and to help provide a more personalized experience;
• Your browser type and other technical specifications such as device ID, hardware/software type, internet service provider, serving domains;
• Files that allow us to “recognize” you when you navigate the Site, to credit your account for various online transactions and collect data such as analytics, page views, targeting data, ad views, and interaction data; and

Collecting Information from Children Under the Age of 18

Our Site and System are not designed or targeted for children, and we do not knowingly collect, maintain, or use Personal Information from any person under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us so that we may delete such information. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Information on our System without their permission. Providing the AirScooter flight experience and performing the essential functions of the System including responding to inquiries, fulfilling requests, providing support and troubleshooting, data aggregation, analysis and report creation to assess marketing effectiveness and/or business performance, and communicating with users about their use of the System or responding to a user initiated inquiry on the System.

Communicating with users about our services
Sending or initiating direct marketing programs, such as newsletters or information about new programs we are offering; using content from social media platforms where users discuss our programs or use a hashtag related to our programs.

Personalizing user experiences on our System
Tailoring content on the System based on user location, preferences, and other personalization factors.

Analytics and System improvement
Tracking information about your visits to our Site or use of the System to allow us to provide better service, using certain online preferences in the aggregate across all users to evaluate the System and develop additional services to offer.

Compliance with legal obligations
Sharing information as required or appropriate to comply with the law or a legal proceeding, such as in response to a subpoena or court order, to detect and investigate security incidents and potentially illegal or prohibited activities or to protect your, our, or others’ rights, property, or safety.

We will not share personally identifiable information in these instances, other than as described in this Privacy Policy.

We will not share your information with unaffiliated third parties to directly market their products to you.

 

We may provide user information to our service providers or vendors for reasons such as:

• Maintenance or development of our System

• Providing products, and offerings related to our AirScooter flight experience
• Development of online resources to further our mission

We may also disclose your information to a third party as part of reorganization or a sale of the assets of Z-USA. Please be aware that you will continue to receive certain communications from us that are necessary for our services. If you are having difficulty unsubscribing from our marketing emails using the above method, please contact us directly by email. 

 

By providing your phone number and [checking the SMS text box/clicking “I Agree”], you consent and agree to opt-in to receive automated text messages. Message frequency depends on the marketing offers we provide.  You may opt out of receiving text messages by texting “Stop” at the end of any message you receive, or you can opt out of these communications by contacting us at contact@zapata.com and sharing the phone number that you would like to opt out. You may also reply “Help” for help. Messaging and data rates may apply.

 

We may disclose your SMS opt-in or consent status, with third parties or marketing affiliates that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages. We will not share or sell your phone number, your opt-in to the SMS with third parties for their direct marketing purposes or for purposes unrelated to our services or Site. Our System may contain links to other websites. These websites may have privacy policies different from our Privacy Policy. The System may also contain certain social media icons or widgets, such as Facebook, Instagram and Youtube. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on social media or other third-party websites is governed not by this Privacy Policy but by the terms of use and privacy policy of the particular platform.

 

Other Third Party Websites

 

Our third party service provider, Bookeo Pty Ltd (“Bookeo”) manages the scheduling of our AirScooter flight experience. Bookeo collects and processes your Personal Information pursuant to its privacy policy, https://www.bookeo.com/privacy/. We encourage you to review their privacy practices and understand how your information is used and processed. By completing a booking, you consent to their collection of your Personal Information and if you have any questions about how your Personal Information is handled by them, please contact Bookeo directly.  

 

Payment Information

 

We use third-party payment processors, such as Stripe, to process payments. Your credit card details are communicated directly from your browser to these payment processors. Z-USA only sees the payment card type, the last four digits of your credit or debit card number and billing address. Please see Stripe’s terms of service and privacy policy for more information on how they use, and store your personal information.

 

How is User Information Protected?

 

We make reasonable efforts to maintain administrative, physical, and technical safeguards for all Personal Information collected in our System, designed to protect your Personal Informationfrom unauthorized access and against unlawful processing, accidental loss, destruction and damage. Unfortunately, the transmission of information via the internet is not completely secure, we cannot make any guarantees as to the security or privacy of your Personal Information.

We retain data collected from you for as long as necessary to complete the purpose for which it was collected.

 

Your Privacy Rights

 

You may have the right to submit certain requests relating to your Personal Information as described below based on applicable laws. Please email us at contact@zapata.com to submit data requests.

• Right to access and data portability. You can request and receive a copy of the Personal Information we have collected, used, or otherwise processed and you can confirm what Personal Information has been collected.
• Right to correct inaccuracies. You can request that we correct any inaccurate Personal Information we may have.  
• Right to delete. You can request deletion of your Personal Information.
• Right to opt-out.  You can opt-out of targeted advertising, the sale of your Personal Information or limited sharing of your Personal Information.
• Right to appeal. At times we may be unable to process requests relating to your Personal Information, in which case, your request will be denied. If your privacy rights request has previously been denied by us and you believe we denied it in error, you may appeal for reconsideration of your request via emailing contact@zapata.com
Please note that we may need to authenticate your identity before your request can be processed, providing us with 2-3 pieces of Personal Information which we will match to information we maintain about you. For authentication, you may be asked to provide certain Personal Information that we will match against our records. You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed.

 

Non-Discrimination

 

We will not discriminate against you in a manner prohibited by the applicable state laws because you exercise your privacy rights. While you may request to delete your Personal Information, such deletions may affect our ability to offer the System to you.

 

 

Users outside of the United States

 

Our Site is hosted in the United States and by third parties in other regions and is intended for visitors located within the United States. If you choose to use the Site from the European Union or other regions of the world with laws governing data collection and use that may differ from United States law, then please note that you are transferring your Personal Information outside of those regions to the United States for storage and processing.

Also, we may transfer your Personal Information from the United States to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Site and System. By providing any information, including Personal Information, on or to the Site, you consent to such transfer, storage, and processing.

 

Do Not Track Signals
